The involvement of

The Framework Directive 89/391/EEC

The Framework Directive 89/391/EEC which sets the bases for Health and Safety at Work.

These obligations, which have been transposed in the various countries of the European Community, are part of the 9 prevention principles:

Avoid risks

Assess residual risks

Fight again risks at source

Adapt Work to individual

Adapt work to technical progress

Give appropriate instructions

Developp a coherent overall prevention policy

Replace the dangerous by the non- or the less dangerous

Priorize collective protective measures

It provides in particular in its article 7 the obligation to appoint an Employee competent in matters of Occupational Safety and Health. The mission of this (these) Employee(s) who must be trained is to assist the employer in his obligations in terms of Health and Safety at work.

 

The same article also provides that if the skills are not available within the company or if they are insufficient, the employer has the obligation to use external service providers. These obligations have been transposed in the different countries of the European Community. It follows from this directive that the employer can be condemned in the event of a breach. It should be noted that there are differences in approach depending on the legislation and case law of each country
